In an effort to maintain this stance, we provide this privacy statement (the “Policy”) in relationship to your use of the Digi “Cloud Service” (the Digi Device CloudSM service or any of its editions, including the Digi Remote ManagerSM service) and all associated websites, databases and domains.
For the purposes of this Policy, “Personal Information” means information that (alone or when in combination with other information within Digi’s direct control) can be used to directly or indirectly identify, locate or contact an individual, e.g. consumer or customer and that can be linked to that individual. The term “you” and related pronouns will refer to each user (and each person or entity responsible for users) of the applicable Cloud Service.
1. Scope
Digi is a global organization with legal entities, business processes, management structures and technical systems that cross borders. This Policy applies to Cloud Services and all associated websites, databases and domains where Personal Information is collected, stored, transferred, used or otherwise processed. This Policy also covers the use of a Cloud Service website for consumer and marketing practices and social media activities, unless there is a specific privacy policy for a given website or specific information practice.
Please note that when you enter any sub-sites accessible through this website, such sub-sites may be operated by different entities of Digi, be for different purposes or may have their own privacy policies or terms of use specific to those sites. 2. Personal Information Collected
Digi collects and uses Personal Information only to achieve its business purposes and in compliance with applicable law. We may disclose it to recipients indicated in section 6 of this Policy.
2.1 Use of a Cloud Service Website
Digi may collect, maintain and process Personal Information provided by or concerning users, on and through the website. We collect Personal Information from visitors to the website in order to better understand you and to respond to your needs and expectations. We may use Personal Information you have submitted to us for our internal purposes, including administration of our websites, security, data analytics and compliance with our legal obligations, policies and procedures.
By using a Cloud Service website you represent that 1) the Personal Information you provide is accurate, up-to-date and relevant for the purposes you provide it; 2) you are of sufficient legal age and have the authority to use the website (and to bind your company, where relevant), and 3) that you have read this Policy and consent to the use of your Personal Information collected by Digi as described in this Policy if you provide Personal Information about a third person, you represent that you have the authority to provide us with his or her Personal Information and that you have received such consent on his or her behalf.
Use of a Cloud Service website is voluntary and Digi will not collect any Personal Information about you, unless you provide it to us. If you do not wish for Digi to collect and process any Personal Information about you, do not provide it to us. We may also collect certain technical information by automated means when you visit a Cloud Service website and related websites, such as how many users visited our websites and the pages accessed. By collecting this information, we learn how to best tailor our websites to our visitors.

2.2.1 User Accounts
For the use of a Cloud Service, we may provide you with a user account. These accounts are subject to the terms and conditions of any associated Account Agreement and the Terms of Service - Digi Cloud Services (the “Terms of Service,” available at http://www.digi.com/legal/cloud-terms) and policies referenced in those Terms of Service, including an Authorized Use Policy (http://www.digi.com/legal/authorized_use_policy) and guidelines respecting the Digital Millennium Copyright Act (http://www.digi.com/legal/dmca_statement). We will use your Personal Information to provide you with access and the ability to use the applicable Cloud Service and for any other purposes related to it. We may also use your contact information to market similar products or services.
2.2.2 Product Information Request Forms
If you request information about our products, we may ask you to provide details such as your name, email address, telephone number and intended use of the relevant product. We use your details to send you the information you request. You also may choose to provide additional comments and requests.

3. Choice/Opt-In
Digi only sends correspondence to parties that have provided their email addresses and consent (‘opt-in’) to receiving marketing correspondence. Users are given the opportunity to 'opt-out' of having their information used for purposes not directly related to our website in each communication. 4. Transfers from EEA Countries and Switzerland
4.1 Digi as a Controller
Generally, we only transfer Personal Information to accomplish Digi's business purposes as stipulated in this Policy and in compliance with applicable law. We may transfer Personal Information pertaining to you outside of European Economic Area (“EEA”) to the countries that are not considered to provide the same level of protection for your Personal Information as the countries within the EEA. Digi has taken the necessary measures to ensure that all Personal Information transferred receives an adequate level of protection.
By providing us with your Personal Information, you acknowledge that Digi is located in the United States and you consent to the transfer of your Personal Information to Digi in the United States for the purposes specified in this Policy.
4.2 Digi as a Processor
As part of a Cloud Service, customers are permitted to upload or transmit information, which could possibly include Personal Information. In this context, Digi acts as a processor or agent of the customer and does not determine how its customers’ data is utilized in the Cloud Service nor choose the type of data that is submitted. Any access to or use of this data by Digi is incidental to the achievement of its contractual obligations with its customers. Digi’s obligations in this context are not contained in this Policy and the customer remains responsible for the Personal Information that it uploads or transmits to the Cloud Service and for compliance with data protection law, unless otherwise defined in its agreements with Digi.
5. Security
Digi will maintain administrative, technical and physical security safeguards that are reasonably designed to protect Personal Information from loss, misuse and unauthorized access, disclosure, alteration and destruction. Digi employees and contractors who have access to Personal Information are obliged to respect the privacy of our visitors and customers and the confidentiality of their Personal Information. We will employ controls reasonably designed to: (a) prevent acceptance of cardholder data transmitted via unsecured channels (a practice prohibited by the Terms of Service) and (b) if we detect that you have transmitted cardholder data via unsecured channels, give you prompt notice of the transmission and remove the affected data from the Cloud Service.
6. Disclosures to Third Parties
In addition to the uses outlined in this Policy, we may disclose your Personal Information (i) if we are required to do so by law or legal process, (ii) to third parties who provide services to Digi, (iii) to law enforcement authorities or other government officials, or (iv) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity. If we detect that you have transmitted cardholder data via unsecured channels, we may notify the card issuer and provide details of the unsecured transmission. We may also disclose your Personal Information upon your written request or with your written consent.
When we do use third parties to provide services, we take privacy and security seriously. We choose providers who are industry leaders to secure and protect your Personal Information. Cloud Services are hosted on Rackspace servers in the United States or the United Kingdom (or a similar service provider having comparable security measures in place).
Subject to applicable law, we reserve the right to transfer any Personal Information we have about you in the event we sell or transfer all or a portion of our business assets. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use Personal Information you have provided through our websites in a manner that is consistent with this Policy.
7. Data Retention
Digi has implemented a comprehensive data retention policy. Your Personal Information will be retained according to the rules of US law and usually for the length of any statute of limitation period. After expiration of the relevant terms, your Personal Information collected by Digi is deleted.

Digi provides individuals with reasonable access to the Personal Information maintained about them and gives users the following options for changing and modifying information previously provided.
